Disclaimer & Assumption of Risk

Version 1 — last updated Oct 25, 2026

Please read this document carefully. By purchasing access to the guide, or by building, operating or relying on anything in it, you agree to these terms. In this document, "we", "us" and "the Owner" mean the owner and operator of this website, and "you" means the member or visitor.

1. Informational purposes only

The guide describes a do-it-yourself design for a powered gold sluice. The design is a work in progress and is still being revised by the community. Dimensions, parts, materials, procedures and diagrams may be incomplete, unverified or wrong, and they will change. Everything on this website, including the guide, parts lists, diagrams, comments and member photos, is provided for general informational purposes only, on an "AS IS" and "AS AVAILABLE" basis.

2. No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE GUIDE OR ANYTHING ELSE ON THIS WEBSITE. THIS INCLUDES ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ABOUT THE ACCURACY, COMPLETENESS, RELIABILITY OR CURRENCY OF MEASUREMENTS, PARTS LISTS, VENDOR LINKS, PRICES OR INSTRUCTIONS. WE DO NOT WARRANT THAT A SLUICE BUILT FROM THE GUIDE WILL BE SAFE, WILL WORK, OR WILL BE SUITABLE FOR ANY PURPOSE.

3. Assumption of risk

Building and using a sluice involves real hazards. These include, without limitation: power tools; cutting, drilling and grinding; sharp metal mesh and cut edges; sealants, adhesives and solvents; 12 V batteries and electrical wiring used near water; lifting and carrying heavy equipment; and working in or near streams and rivers, where there is a risk of drowning, hypothermia, slips and falls, swift or rising water, and flash floods. Remote locations can also delay emergency help.

You voluntarily choose to build and operate the equipment and to take part in these activities. You knowingly and freely assume all risks, whether known or unknown, of injury, illness, death and property damage that arise from doing so, to the fullest extent permitted by law. You are responsible for your own safety and for the safety of anyone you allow to help you or to be near you. Use appropriate protective equipment, follow the manufacturer's instructions for every tool and product, and never work alone in or near moving water.

4. Not professional advice

Nothing in the guide or on this website is engineering, electrical, safety or legal advice, and no professional relationship is created by your use of it. Consult qualified professionals, such as a licensed electrician or an attorney, before you rely on any information here, and in particular before you do any electrical work or operate equipment near water.

5. Compliance with laws

You are solely responsible for knowing and following all federal, state and local laws and rules that apply to you. These may include mining claim and land-ownership requirements, permits and authorizations, suction-dredge and motorized-equipment rules, water-quality and discharge rules, and rules on access to public and private land. Some jurisdictions ban or restrict motorized prospecting equipment altogether. Building or using equipment described in the guide may be illegal where you are. We do not tell you what is lawful in your location, and you must not enter or work on land without the right to do so.

6. No guarantee of results

We do not promise that you will recover any gold or other minerals, or any particular amount of them, or that you will earn any money or reach any other result. Results depend on location, conditions, materials, workmanship and many other things outside our control.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OWNER, ITS AFFILIATES AND CONTRIBUTORS, AND THEIR RESPECTIVE OFFICERS, MEMBERS, EMPLOYEES AND AGENTS, WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR EQUIPMENT, ARISING OUT OF OR RELATED TO THE GUIDE, THIS WEBSITE OR YOUR BUILDING OR USE OF ANYTHING DESCRIBED IN THEM, UNDER ANY LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR MEMBERSHIP.

Some jurisdictions do not allow certain limitations or exclusions, so parts of this section may not apply to you. In that case our liability is limited to the smallest extent the law allows.

8. Indemnification

You agree to defend, indemnify and hold harmless the Owner, its affiliates and contributors from any claim, loss, liability, damage, cost or expense (including reasonable attorneys' fees) that arises from your building or use of equipment based on the guide, your violation of any law or of these terms, or your violation of the rights of any other person, including any injury to another person or damage to their property.

9. Third-party products and links

The guide names parts, tools, products, vendors and websites, and links to some of them. We do not endorse them, we do not control them, and we are not responsible for their content, availability, quality, safety, prices or practices. Any dealings you have with a third party are between you and that party.

10. Community content

Comments, replies and member photos are posted by their authors. They are the views and experience of those authors, not ours, and we do not verify or endorse them. Do not rely on them as instructions or as advice.

11. Changes to these terms

We may update this document from time to time. The version number and the date of the last update are shown on this page. When the text changes, the version number increases. The version in force when you purchase is recorded with your purchase. Continuing to use the guide after an update means you accept the updated terms for that use.

12. Severability

If any part of this document is found to be invalid or unenforceable, that part will be enforced to the greatest extent permitted, and the rest of this document will stay in full effect.

13. Governing law

This document, and any dispute arising out of or related to it, is governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in North Carolina have exclusive jurisdiction over any such dispute.
